Media Match US Ltd

These are the terms on which we are prepared to provide our services. They shall apply to the exclusion of all others and shall be construed in accordance with the Laws of England. Any variation to these terms must be agreed in writing.

In consideration of you agreeing to the following terms you are entitled to enter, in prescribed form, your resume information (the "Information") on to a Web Page on our Website (the "Website"). The website includes . On payment of our Service Fees you shall be entitled to our "Subscription Service". Under the Subscription Service we shall make the Information you provide available to such potential employers who visit our Website. In addition to entering the Information the subscription Service shall also allow you to diarise your availability for work.

In respect of those subscribing for the Subscription Service we agree to use our reasonable endeavours to ensure that the Website is available [24 hours a day] (the "Service"). In the event that this is not possible we shall endeavour to rectify any problem as soon as reasonably practical.

This is the total extent of the our liability and is in lieu of all other terms, conditions, warranties and representations, express or otherwise to be implied, including, but not limited to, any implied terms of merchantability, satisfactory quality, or fitness for a particular purpose. We reserve the right to withdraw the Service and/or remove the Information from the Service on us providing one weeks notice in writing to you.

We shall not, in any circumstances, be liable whether in contract, tort, or otherwise for any indirect, special or consequential damages, howsoever arising (including but not limited to loss of anticipated profits). Our total liability shall be limited to the amount of Service Fees received by us in the current 12 month period.

The purpose of media-match is that people working within the entertainment industry can network with each other more easily. While we have thousands of Company and Individual members who may use media-match to view the resumes of Individual members, or they may choose to place their company vacancies on the Jobs Board, we cannot guarantee work. We cannot guarantee that Employers who view your resume will do so for the purposes of employment, call you in for an interview or that you will be offered a position after interview. Those decisions rest with the Company and Individual members.

You undertake not to 'spam' your fellow Individual Members with emails prospecting for employment, on the understanding that they may well be in the same position as you. Individual Members who do this may have their membership cancelled indefinitely.

You undertake not to abuse the system by applying to positions for or on behalf of another individual. Individual Members who do this may have their membership cancelled indefinitely.

Any electronic correspondence sent to your registered email address from the Service is intended for you, the recipient only. Your account is at risk if you forward emails that contain links relevant to your individual subscription.

We are unable to verify or provide any assurance relating to the nature or duration of any work or appointment that you may be offered as a result of using the Service. It remains your sole responsibility to ensure that any work or appointment is acceptable to you.

You warrant that the Information you provide shall be accurate and correct and shall not contain anything that could be considered inaccurate, obscene, defamatory or which potentially infringes any third party right. You agree to indemnify us for all losses, costs and damages we incurr in the event that you are in breach of this warranty.

You are prohibited from re-posting any job ads or resume information.

In the event of you agreeing to subscribe to our Subscription Service you agree to pay the Service Fees. Payment of Service Fees are due monthly in advance or annually. Failure to pay shall result in the immediate removal of the Subscription Service. In some cases, depending on your bank, a small foreign transaction fee (approx 0.5 cents) may also apply.
